Terms of Service
These General Terms and Conditions of Sale govern subscriptions and the purchase of credits on the Kliptix platform (AI-driven automated video generation), provided by Eldoranext. By ordering, you accept them in full without reservation.
1. Pricing
List prices are shown exclusive of tax (ex. VAT). Applicable VAT is determined at checkout based on the billing country:
- Customers in France: French VAT at the current statutory rate (20%).
- EU customers (outside France): 0% VAT if a valid intra-EU VAT number is provided (reverse charge), otherwise 20%.
- Non-EU customers: 20% by default, unless a registered non-EU entity is declared with valid information where required.
2. Payment
Payment is processed securely by Stripe. Credits are credited to your account automatically after payment confirmation. Available payment methods depend on Stripe; full card or bank data are not stored on our systems (they are processed by Stripe).
3. Use of credits
Each run consumes credits according to the quality tier and block (duration) you select, as shown on the site at the time of purchase (e.g. Eco, Standard, Premium, in credits per 5 second block). If a failure is attributable to the platform or an internal quality check rejects a render, the affected credits are recredited in line with the policy published at the time of generation.
4. Rights to deliverables
Subject to law, third-party rights and these terms, you obtain use of the delivered files in line with your plan or pack. Tiers may differ (personal, professional, extended commercial use as offered at sign-up); only what is clearly stated in Kliptix applies.
5. Termination
Recurring subscriptions may be cancelled at any time in the Stripe customer portal; the current period remains due and there is no pro-rata refund, except where mandatory law requires otherwise. Prepaid credit packs remain usable on the terms stated at purchase (validity, expiry if any).
6. Service built on artificial intelligence
Kliptix chains multiple AI models (text, image, audio, video, etc.) through technical partners. Depending on routing, model availability and your settings, processing may run:
- in the European Union, the United Kingdom, the United States or other countries (including the People’s Republic of China) depending on the model vendor;
- via an API aggregator (e.g. an OpenRouter-style layer) that calls publishers located in different jurisdictions;
You are solely responsible for whether a use case fits your duties (legal privilege, special categories of data, etc.). We aim for reliable operations, but AI can produce errors or imperfect results: human review of your final content is recommended.
7. What data is sent to AI engines?
Account identification data (name, email, billing address) is not provided to model vendors solely in order to generate a video. It is used internally and by our payment provider (Stripe) for account, billing and accountability. Only the content and parameters required for the job (script, instructions, style, voice, assets or files you add) is sent, through our technical providers, to the engines that run each step. Do not type unnecessarily sensitive data into prompts (health, trade union, political, etc.) unless your production actually requires it.
8. Your content, your responsibility
You are solely responsible for text, media, music, voice choices, and for any public use of outputs. You warrant that you hold the required rights and permissions and that you do not infringe any third party. You shall indemnify Eldoranext, on first demand, against any claim, fine or reasonable legal fees arising from a breach of that warranty or from unlawful use. We may refuse, suspend or terminate accounts or runs for manifest abuse, fraud, illegal content, or child sexual abuse material. Unlawful content may be reported to the contact e-mail (LCEN) with enough detail to locate the item; we are not required to pre-screen hosted content, but we act in due course once on notice in accordance with the law.
9. Account, access, security
You provide accurate details and keep passwords or login links secret. Activity logged to your account is deemed yours, unless you prove account takeover. We are not liable for outages of third parties, your device or ISP, or for announced maintenance, beyond reasonable best efforts for a small business. No specific uptime rate is guaranteed, without prejudice to mandatory consumer rights.
10. Availability, changes, force majeure
The service, models, credit pricing, AI routing and integrations may change. We may give reasonable notice before or after material changes, without you being due compensation for the change alone, except where a consumer may not be bound to an unduly onerous change. Force majeure or fortuitous event (Civil Code) includes: widespread network failure, war, public authority, strike beyond our control, critical third-party provider outage, natural disaster, pandemic, or host or model failure that cannot be avoided. Deadlines and performance may be extended accordingly.
11. Performance, no success guarantee, AI
The service is generative AI. No business outcome, ranking, revenue, error-free use, or non-infringement of third parties is guaranteed, to the full extent allowed by law, without waiving any mandatory liability for fault or non-performance. Outputs are not legal, tax, medical or financial advice. Resemblance to real people, works or trade marks may come from model training: verify before use. You are responsible for compliance with the laws and languages of the audience you target outside the settings we offer.
12. Monetary cap on liability (other than inexcusable fault, fraud, duress)
Except for wilful misconduct or fraud, and only to the extent permitted for consumers, our aggregate annual liability to a professional is capped at the amount (incl. tax) you paid to Eldoranext in the twelve (12) months before the event, and in any case to recredit of affected credits, without waiving your rights under arts. 1217, 1223 of the French Civil Code or applicable conformity/hidden defect warranties. Indirect loss (lost profit, opportunity, reputation, data—except as required to notify a breach) is excluded to the legal extent. No personal liability of staff or subcontractors.
13. Right of withdrawal (EU consumers) — digital content
As a consumer under French law you have 14 days to withdraw from a distance contract, except where you expressly asked for the digital service to start before the end of that period, accepted the loss of withdrawal, and the service (or use of credits) has begun, in line with art. L. 221-25 of the French Consumer Code. In practice, each generation and credit use constitutes such performance. Refunds, where they apply, follow Stripe; mediation or the EU ODR may apply as in the legal notices.
14. Mediation, disputes, class actions
Consumer disputes are subject, subsidiarily, to an amicable step, then to competent courts, without prejudice to any mediator or ODR as stated. Invalid clauses do not affect the remainder where possible.
15. Governing law, forum, language, evidence
These terms are governed by French law. For consumers, mandatory jurisdiction rules apply where required. For B2B, exclusive jurisdiction of the courts of Eldoranext’s registered office, unless otherwise agreed in writing. The French GTC is the reference language; other languages are a courtesy. Invoices, logs and time-stamped records are admissible evidence unless disproved.
16. Personal data, cookies, GTC changes, contact
Data processing is governed by the privacy policy. Session or analytics cookies, when used, will be described in line with ePrivacy, GDPR and CNIL guidance. Eldoranext may amend the GTC; material changes will be signposted (e-mail, banner, or “last updated” date). Continued use may constitute acceptance, or you may end the relationship where the law so allows. The commercial e-mail is that on the company’s registration; for data, see the privacy policy. Subscription auto-renewal, if any, is described at checkout or in Stripe as applicable.
